Abortion record case reviewed
Planned Parenthood initially defeated parents' request

The Ohio Supreme Court, in a rare move, has agreed to reconsider whether the
parents of a St. Bernard 14-year-old who got an abortion without their
consent can review records involving abortions performed on other minors.

Wednesday's announcement reverses a 4-3 January decision by the court not to
hear the case of "John and June Roe" vs. Planned Parenthood of Southwest
Ohio. That decision meant the records would remain sealed.

Now, with a review under way, those records could be released.

Attorneys for the family are not seeking names, just statistical data.

"I am really ecstatic the Ohio Supreme Court will look at what we think are
extremely important issues related to the issue of child abuse," said Brian
Hurley, the lawyer representing the girl's family.

Planned Parenthood is prepared for a fight.

"We take very seriously the confidentiality of our records," said Becki
Brenner, CEO and president of Planned Parenthood of Southwest Ohio. "We'll
fight to ensure our patients' most personal information remains private and
honor the trust they place in us.

"The records they want are not pertinent to the case," she said.

The lawsuit, filed in Hamilton County Common Pleas Court in March 2005,
alleges Planned Parenthood performed an unlawful abortion on the teenager by
failing to get parental consent as required by law. The suit also alleged
the girl did not give informed consent and that the clinic failed to report
suspected child abuse.

The cases stems from the sexual molestation of the girl by her St. Bernard
soccer coach, John Haller, in 2004. When the girl got pregnant at age 14,
she gave the clinic Haller's phone number, saying that was how her father
could be reached, according to the lawsuit.

Planned Parenthood and the girl's family disagree about whether a call was
actually made.

Haller was convicted of sexual battery, served a three-year prison term and
is now on parole.

The abortion came to light in that case. Hamilton County prosecutors
investigated and found Planned Parenthood did nothing wrong.

Hurley sought records of abortions given to all patients under 18, arguing
they could establish a pattern. A Hamilton County Common Pleas judge ordered
the release of those records, a decision Planned Parenthood fought and won
when the 1st District Court of Appeals said the records weren't pertinent to
the case.

Hurley appealed that ruling to the Ohio Supreme Court.

The girl's family is seeking damages and wants the court to mandate that
Planned Parenthood follow the law and provide more information to those
seeking abortions.
