Patient privacy must prevail in records sweep

Johnson County District Attorney Phill Kline is spending a great deal of time trying to obtain information about former patients of the Overland Park Planned Parenthood Clinic.The information is contained in records that women patients rightfully expected would remain confidential.  Kline’s demands have gone beyond what a special counsel and a judge have deemed is necessary for a grand jury to do its work.Once again, Kline is displaying contempt for patient privacy as he uses a public law enforcement office to carry out his crusade against abortion providers.The grand jury is acting on a petition by abortion opponents, who gathered enough signatures to obtain an investigation into vague and far-fetched allegations that the Planned Parenthood clinic was failing to comply with certain Kansas laws.In response to a subpoena, Planned Parenthood turned over partial medical files from 16 patients, with names and identifying information redacted.  Attorneys for the clinic have said jurors were satisfied with the information provided.Kline’s quest for additional information raises questions about his motives.  His record of seeking reasons to file charges against abortion clinics suggests that he may be using the grand jury investigation to pursue those ends.Separate from the grand jury probe, Kline has filed 107 charges against the Overland Park Planned Parenthood clinic.  A preliminary hearing is scheduled for April.As Kansas attorney general, Kline worked tirelessly to obtain information he thought could be used against the state’s abortion providers.  Voters indicated their displeasure by resoundingly defeating Kline in the 2006 election.As feared, however, Kline took his anti-abortion crusade to Johnson County after Republican committee members foolishly allowed him to fill a vacancy in the district attorney’s office.It falls to wiser parties in the legal system, as well as Planned Parenthood, to protect the privacy of patients in the face of Kline’s continuing onslaught.
