Sedgwick County Judge Clark Owens on Wednesday denied a defense request to dismiss charges against Dr. George Tiller of Wichita or throw out evidence because of the conduct of former prosecutor Phill Kline.
Owens found that Kline's conduct during the investigation of Tiller did not warrant such action.
Tiller is scheduled to go to trial on March 16 on 19 misdemeanor charges alleging he failed to obtain a second opinion for some late-term abortions from an independent physician, as required by Kansas law.
Kline, an anti-abortion Republican, began investigating clinics when he served as Kansas' attorney general from 2003 to 2007.

Washington, DC -- Kathleen Sebelius, the pro-abortion governor of
Kansas who has been criticized for supporting late-term
abortions, is now seen as the most likely pick for Health
Secretary. Should President Barack Obama select her, it would add
to his growing pro-abortion record as president.

picture of the extent to which Planned Parenthood fails to report
adult-child sexual relationships.

Phill Kline for investigating them. They have also filed hundreds of
pages of ethics complaints, which continue nonstop to this day.
Despite a hostile Kansas Supreme Court,
the majority of whom were appointed by a hostile governor who gets
campaign money from Tiller and who has even hosted a party for him at
her mansion, and various other hostile public officials who are on the
dole for Tiller and/or Planned Parenthood, nothing has stuck to Kline.
