After a judge delayed next week’s preliminary hearing in the case, Kline said Wednesday that he wants the high court to reconsider its order banning a Topeka judge from testifying.
Kansas Supreme Court documents unsealed May 2 show that Shawnee County District Court Judge Richard Anderson has “clearly relevant information,” Kline said during a news conference in his office.
And preventing Anderson from testifying is impeding his ability to proceed, Kline stated in a motion to intervene that he filed Wednesday with the Kansas Supreme Court.
But Planned Parenthood attorney Pedro Irigonegaray said Anderson’s opinions are based on incomplete information and are “irrelevant to the issues now before this court.” He noted that the state attorney general’s office has already investigated and found no evidence of wrongdoing.
Kline filed 107 felony and misdemeanor charges last fall against Planned Parenthood of Kansas and Mid-Missouri and its Comprehensive Health clinic. They include accusations of falsifying abortion reports submitted to the state and performing illegal late-term abortions
Planned Parenthood maintains the charges are politically motivated.
Anderson oversaw Kline’s inquiry into Planned Parenthood and another abortion clinic while Kline was Kansas attorney general.
Anderson allowed Kline to forward redacted patient records to Johnson County before Kline became district attorney. And Anderson still has copies of the Planned Parenthood records himself, which Kline wants him to bring to the preliminary hearing.
In the motion to intervene, Kline cites several statements Anderson made in the previously sealed documents:
•In an April 10, 2007, hearing that Anderson conducted, Anderson told an assistant attorney general that there “is evidence of crimes in those records that need to be evaluated.”
•In an Oct. 19 filing to the Supreme Court, Anderson stated it appeared that “someone has manufactured” part of the records.
•In the same Oct. 19 filing, Anderson stated that the “recent disclosures of possible false writings … in context could mean that somebody may have committed a felony in an attempt to cover up a misdemeanor…”
And in a Jan. 16 hearing in Johnson County District Court, Kline noted, Anderson testified that he had concerns about late-term abortion reports provided by Planned Parenthood. He asked a document expert to examine them, he said, and the expert said the documents “do not match up.”
Kline said the court did not give a legal reason for its order prohibiting Anderson from testifying, and he would like to have one.
Irigonegaray, the Planned Parenthood attorney, discounted the value of Anderson’s statements.
“What little information was available to Judge Anderson obviously led him to believe that perhaps there were questions that needed to be answered,” Irigonegaray said. “What is important to know is that those questions were answered by a very competent and thorough investigation performed by the attorney general’s office.
“(Former) Attorney General Paul Morrison had the benefit of a full and complete review of all of those records and concluded that there was absolutely no evidence of criminal conduct – none whatsoever.”
On Wednesday, in Johnson County District Court, Judge Stephen Tatum delayed next week’s preliminary hearing in the case to July 21 and 22.
Planned Parenthood attorneys had asked that the hearing be delayed until after the Kansas Supreme Court decides whether Kline has legal possession of the abortion records he plans to use in his prosecution. Oral arguments on that issue are scheduled for June 12.
“Those records are at the heart of this case,” Irigonegaray told the judge.
Kline did not object to the delay because he does not want to proceed without Anderson. But he doesn’t want to wait until after the Supreme Court issues its ruling.
The unsealed documents arise from two lawsuits now pending before the Kansas Supreme Court.
Planned Parenthood filed one suit on June 2, 2007, against Kline, seeking to get the records back.
In August, the Kansas attorney general’s office sued Judge Anderson. Attorney General Steve Six contends the records should be returned to Planned Parenthood because Morrison cleared it of wrongdoing.
