'Off the hook.' The courts and the Legislature are moving in opposite directions regarding secrecy. The Johnson County grand jury investigating Planned Parenthood, after being prevented from examining original records from which all patient identifying information had been removed, this week declined to file charges against the Overland Park abortion clinic.
Three days earlier, the Kansas House overwhelmingly passed a measure to limit judges’ ability to keep records and hearings shielded from the public. The bill's sponsor, Rep. Lance Kinzer, R-Olathe, said he pushed for passage because, “I have been troubled by the fact that the Kansas Supreme Court has been conducting at least two important judicial proceedings in complete secrecy.” Kinzer identified the two cases turning on abortion records as Planned Parenthood v. Kline and State v. The Honorable Richard Anderson, which are still pending before the high court.
Kinzer's proposal, HB 2825, was supported by both the Kansas Press Association and the Kansas Association of Broadcasters and passed the House by a vote of 122-1. Although no lawmakers voiced opposition to the bill during its debate, Planned Parenthood attorney Pedro Irigonegaray later told the Associated Press, "For the judiciary to work effectively, it must be independent, and the independence of the courts, I believe, is being adversely challenged here."
Senate Judiciary Committee Chair Sen. John Vratil, R-Leawood, had already given the plan a cool reception. In an AP report, Vratil said, "I'm always reluctant to legislatively alter the way the court does its business. The court generally knows best how to conduct its business, and the Legislature ought to respect the separation of powers."
In reacting to the Johnson County grand jury’s decision, the Kansas City Star quoted Planned Parenthood President Peter Brownlie, who said, “That affirms our contention throughout that we’ve had nothing to fear from this investigation.” However, Tim Golba, of the Life Is For Everyone Coalition, told the AP, “Planned Parenthood cannot claim they are free of any indictment, because the full evidence never reached the grand jury.”
Dozens of protesters also held a rally outside the Johnson County Courthouse condemning District Judge Kevin Moriarty's treatment of evidence in the grand jury proceedings. Critics point out that Moriarty, a Democrat and former law partner of Rep. Dennis Moore, has donated $6000 to various campaigns of Gov. Kathleen Sebelius. He ruled that the grand jury would not be permitted to view the redacted documents they had asked to see. Larry McClain, a special counsel to the grand jury chosen by Moriarty, told reporters the jurors had reviewed "available medical information." The records the grand jury had requested, however, were not included in the unspecified "medical information" they had been given.
“Far from being fair and impartial as a judge should be, Moriarty clearly chose sides in this case,” said Judy Smith, speaking at the rally as state director of Concerned Women for America of Kansas. “As a result, Planned Parenthood has once again been let off the hook due to a faulty implementation of the court system and inaction on the parts of those representing sound rule of law.”
